Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Vokeva AI platform and website (collectively, "the Service") operated by Vokeva AI ("Vokeva", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Vokeva, you confirm that you are at least 18 years old, have the authority to enter into these Terms, and agree to be bound by them. If you are using Vokeva on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Description of Service
Vokeva provides an AI-powered voice and chat agent platform that allows businesses to create, deploy, and manage automated customer conversation agents. The Service includes voice call handling, chat widget deployment, support ticket management, live visitor monitoring, analytics, and related tools.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Accounts
You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access to your account. Vokeva is not liable for any loss resulting from unauthorised use of your account.
You may not share accounts, create accounts on behalf of others without authorisation, or use automated means to create accounts.
4. Acceptable Use
You agree not to use Vokeva to:
- Engage in spam, robocalling, or unsolicited communications in violation of applicable law
- Impersonate individuals or organisations deceptively
- Collect personal data without appropriate consent or legal basis
- Violate any applicable telemarketing, TCPA, GDPR, or similar regulations
- Transmit malware, viruses, or harmful code
- Attempt to reverse-engineer, scrape, or extract data from the platform
- Use the Service for illegal purposes or to facilitate illegal activities
Vokeva reserves the right to suspend or terminate accounts that violate these restrictions.
5. Billing & Payments
Vokeva operates on a usage-based model with no mandatory subscription fees. Every account receives a free monthly allocation of voice minutes, chat messages, and support tickets, which resets at the start of each calendar month.
Top-ups: Once your free monthly allocation is exhausted, your agents will pause. To add credit and resume service, email support@vokeva.com with a minimum top-up of $10 USD. We will confirm receipt and credit your account manually.
Refunds: Due to the nature of usage-based billing, all top-up credits are non-refundable once added to your account. If you believe a charge was made in error, contact support@vokeva.com within 7 days.
Usage limits: We will notify you by email when you reach 80% of your monthly free allocation. We do not charge beyond your credited balance without your explicit action.
All prices are in USD unless stated otherwise.
6. Intellectual Property
Vokeva and its original content, features, and functionality are owned by Vokeva AI and are protected by applicable intellectual property laws.
You retain ownership of all content you upload to the platform (knowledge base documents, agent configurations, etc.). By uploading content, you grant Vokeva a limited licence to use that content solely to provide the Service to you.
7. Your Data
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of customer conversation data complies with applicable privacy laws and that you have appropriate consent from end users where required.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind. Vokeva does not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
To the maximum extent permitted by law, Vokeva's total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total amount of credit you have added to your Vokeva account in the 12 months preceding the claim.
Vokeva is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
9. Termination
You may terminate your account at any time by contacting support@vokeva.com. We may terminate or suspend your account immediately if you breach these Terms, without prior notice or liability.
Upon termination, your right to use the Service ceases immediately. Data associated with your account will be retained for 30 days after termination, after which it will be permanently deleted. Unused account credit is non-refundable upon termination.

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Mumbai, India.
